What are Civil Court Records?
Civil court records fill most of the courts’ dockets. They involve various
types of controversies which generally concern family and contractual relations.
The losing party may not face a single day of imprisonment, but the monetary
damages imposed against him can be equally debilitating.
Civil court records contain documents and transcripts which detail everything
that has transpired in a judicial proceeding involving controversies that do not
concern the violation of any penal law. The transgressions involved in civil
cases rarely result in imprisonment, except for a very few number of instances.
The penalty or consequence that a losing party in a civil case usually suffers
involves restitution.
There are many types of cases that fall within this category, most of them
involving family relations and contracts.
Civil Court Records - Family Issues and Disputes
Any controversy involving family relations are civil in nature. Marriage comes
under the purview of civil court records. Suits concerning marriage usually
involve questions as to the legality of a union. Petitions for divorce, legal
separation, and annulment are also among the commonly filed family court cases.
Civil Court Records - Wills and Succession
Civil court records also contain details regarding the probate of a will.
Probate proceedings basically determine the genuineness of a will and the
validity of its provisions. It identifies the heirs of a testator or a decedent,
and divides the properties of the deceased according to his wishes. If a person
has left no will, then the division will be based on the provisions of the
applicable laws.
Civil Court Records - Contracts
Controversies involving the legality of a contract and its enforcement are
within the jurisdiction of civil courts. Thus, an aggrieved landowner whose
property is being unlawfully detained by an overstaying tenant may lodge a civil
suit to ask for the court’s aid in evicting the tenant.
Civil court records can easily be retrieved on the Internet through an online
database called the Public Access to Court Electronic Records or
PACER.
