Kansas court records come from three places - district, county and municipal courts. Such records can be a goldmine for social historians, genealogists and other types of researchers. Before 1977, the Kansas court system was comprised of the probate and district courts.
The probate court exercised authority over town incorporations, wills, marriages, insanities, estates, adoptions, wills, dependent and/or delinquent children, and similar issues concerning the county. Meanwhile, the district court dealt with naturalizations, monetary claims within specific county boundaries, divorces, major criminal and civil cases and other related matters.
KS Court Records – Where to Look
In general, court records in Kansas involving grave criminal offenses or huge amounts of money were kept by the district court. Records of minor claims, traffic citations and misdemeanor charges were held by the township or municipal courts. There were also circuit, juvenile, criminal and traffic courts in Kansas but these were short-lived. In 1977, Kansas simplified its court system, which put majority of the court divisions under the umbrella label - District Court.
Communities had municipal or city courts on top of the county courts that handled money claims, misdemeanor crimes and traffic violations cases. Though rare, these courts did on occasion have jurisdiction over entire towns. In townships where there was no existing major community, justices of the peace took over and implemented the law, tackling a limited number of cases.
Kansas Court Records– Where To Go for Appeals
When decisions regarding cases don't go a person's way, appeals as well as the court records in Kansas can be used and taken from the state's district courts to the Appeals Court, or even the Supreme Court. The Court of Appeals in Kansas sits in Topeka in the Judicial Center. It hears appeals on criminal and civil cases from the district court as well as appeals upon orders of the SCC (State Corporation Commission).
The Supreme Court in Kansas is located in the same place as the Appeals Court. It's considered the court of last resort and has most of the KS court records. Kansas Supreme Court hears serious criminal and civil cases directly appealed by the district courts. The court also entertains cases that involve statutes that have been declared unlawful.
General administrative say-so over all Kansas courts rests on the Supreme Court. The Court's rules govern Supreme Court and Appeals Court appellate practices as well as district court procedures. The Supreme Court has the power to review court cases already decided on by the Court of Appeals.
