Court records in Idaho are governed by the Idaho Court Administrative law. This
statute governs the handling and disposition of all documents that the state
courts posses. Just like in other states, a visit to the court is necessary when
asking for copies of court records. The state uses the Idaho Statewide Trial
Court Record System, a series of public access computer terminals that allows
people to check or go through court record information in digital form. It
provides a more efficient means to examine court files than by requesting a copy
from the clerk of court.
Accessing ID Court Records
Unfortunately, the Idaho Statewide Trial Court Record System is not available in
all counties. Moreover, it is not connected to the Internet. People would still
have to go to the courts to view the court records that they want. The good news
is that plans are already underway to make the system available in all counties
and over the Internet.
Not all ID court records are available to the public. They include an assortment
of documents, the contents of which could harm the government’s or litigant’s
interests if not kept confidential. Medical records, adoption papers, private
employment records, records pertaining to juveniles, and adoption records are
among the documents that are restricted from public access.
Requests for official copies of court records in Idaho should be addressed to the
records custodian. The keeper of the records has three days from the receipt of
the application to process it. If the custodian thinks that it will take more
than three days to process the request, he must notify the applicant about it
and deliver such documents within ten days. The custodian has the right to deny
any individual access to court records which are deemed to be confidential.
In the event that the records custodian cannot determine whether a court record
should or should not be made available to the public, the requester can refer
the matter to the custodian judge. The custodian judge will set a public hearing
to find out if the record can indeed be disclosed to any person. If a hearing
does takes place, it might take some time before the court could promulgate its
decision. In case the custodian judge does not rule in favor of the requester,
his next option is to file a case for disclosure in the district court.
