What Are Divorce Dockets?

Divorce dockets are the entirety of the court records following a divorce. All the circumstances and evidence behind a divorce will also be included in the docket.

Divorce dockets can be accessed at the county courthouse or the state archives, depending on when the case was filed. A divorce docket contains the original filing of the divorce or annulment and is separated from other civil or criminal cases. It also includes the court decision on the legal separation or dissolution of marriage. Divorce dockets contain information such as the name of the spouses, reasons for filing the divorce and any other circumstances related to it.

Divorce dockets- Reasons for Filing Divorce

The reasons for filing divorce vary greatly from one couple to another. First, you need to determine if your state is a fault or no-fault state. If you reside in a no-fault state, then you can file a divorce without any overriding reason except that you and your spouse have irreconcilable differences. If you reside in a fault state, then you will have to submit a reason for the divorce and need to have been residing in that state for at least ninety days prior to the filing of the case.

Some of the reasons include impotency or the inability of one of the spouses to produce a child, adultery, bigamy or a previous marriage to another individual, alcoholism which may have a detrimental effect on the marriage and the abuse of drugs. Aside from these, infection with a sexually transmitted disease and the conviction from a felony by either of the spouses can also be used as grounds for a divorce. Extreme mental or physical cruelty can also be cited as a reason for the legal separation of spouses. The details surrounding the reason for the divorce will be placed in a divorce docket, together with all the evidence that has been gathered in support of these reasons.

Divorce dockets - Why Need an Attorney?

Everyone is entitled to defend himself or herself in a court of law but it may be more helpful for you to hire an attorney to assist you with the legal complexities of your case. You will need to be clear about the corresponding fees of the attorney at the very start of your case to prevent any misunderstandings once the verdict is out on your divorce case.

In relation to a divorce, the divorce docket can also contain the other court decisions that will arise from your separation such as who retains custody of the children, the amount of alimony that must be provided and the division of the conjugal properties that you owned as a married couple. A visiting schedule may also be arranged by the court and the settling of marital debt may also be decided upon and included in the divorce dockets.
