Marriage and Divorce Records – Being Together and Being Apart…

Unions are important but so are separations. And this is why marriage and divorce records are important vital documents today.

Marriage and divorce records are found in several legal institutions. These include court houses or the city hall where the marriage took place, the Center for Disease Control (CDC), health departments or state departments.

A simple definition for divorce is legally ending a marriage. It is also known as dissolution of marriage. There are four types of divorce, namely (1) agreed divorce, (2) contested divorce, (3) default divorce and (4) publication divorce.

Divorce Further Defined

Divorce is often mistaken for annulment or legal separation. Although all three are petitions filed by either of the two married individuals, their natures are quite different.

In an annulment, the marriage is legally “erased” – meaning, it is as though there has never been any marriage that took place in the legal sense. Therefore, for someone who got married once and later filed and was granted an annulment, legally, it is as though that individual was never married.

In a legal separation, the marriage is neither erased nor terminated (as it is with a divorce). The marriage still exists but the couple can now live apart from each other.

There are several reasons why one would rather go for any of the three legal processes but whatever the case, each situation has its own requirements (or prerequisites if you will) before a judge will grant such a petition.

The prime requisite for an annulment or divorce is a justifiable reason for the marriage.

Why Would Anybody Want Copies of Marriage and Divorce Records?

So why would anybody need to have a copy of marriage or divorce records? For one thing, they are important documents for background checks in certain cases like job applications, entering into contract agreements, tracing genealogy, simple curiosity on some people’s part, and most importantly, when either of a divorced couple intends to get into another marriage. In the latter case, the one interested in the information could be the divorcee’s partner or any of that partner’s parents or loved ones.

Clearly, one cannot be legally married to another when getting married to someone else. Such violation is what is legally termed as bigamy. And for prominent families, they would normally want to avoid such incidents as this would only cause bad publicity and more importantly (to them), is viewed as a threat to their wealth and/or reputation.

In any case, marriage and divorce records are valuable documents that can be retrieved in a couple of ways. The most logical way is to simply go to the source of the records (as mentioned at the beginning of this article).

Another way is to order such records online. The latter method is the most convenient especially if the source of the records is located far from the location of the one ordering them.
