Divorce Certificate - Why It is Necessary

A divorce certificate is a document that states the name of the spouses and the date of the divorce. A certified copy is needed for legal purposes but an uncertified copy can be sent to anyone.


A divorce certificate is the incontrovertible proof that a divorce has been made effective. It contains the name of the individuals in the divorce, the courthouse where the case was tried and the date when the divorce took effect. A divorce certificate can be requested from the county courthouse following the legal proceedings.

When requesting for divorce certificates, there may be differences in procedures from one state to another. Generally, you will have to visit the courthouse yourself, sign a copy of a request form and submit it to them in person. When you claim the divorce certificate that you asked for, you will need to bring proper identification before it can be released to you. You will also need to pay the corresponding fee for each request and every additional copy that you ask for, whether it is certified or uncertified.

A second way to request for a certificate is through the mail. You will still need to fill in and send out the request form. Since the certificate will be mailed directly to you, there will be no need to show proper identification before it is released to you. You should not forget to enclose a check or a money order payment to cover the fees of the request otherwise, this will not be processed.

A third way to request for a certificate is through fax. Similarly, you need to fill out the request form and send it to the courthouse or state archive. Once the request is received, the actual certificate cannot be faxed back to you. It can be sent to you either through regular postal mail or through a courier service, depending on your preference but the corresponding fees will apply.

In some cases, you may not have all the relevant information that is being asked of you in the request form to be able to find the certificate. When this occurs, the least amount of information that you provide should include the name of at least one of the spouses and a frame of time in which to search for the divorce case. If the name of the spouse is common, then you need to provide more identifying information.

A certified copy of a divorce certificate is mandatory if you would like to use it for legal purposes, such as remarriage. An uncertified copy will be released to anyone but a certified copy can only be granted to people whose names are on the record, whether you are one of the spouses, the children, the parents or the grandparents. If you have a letter of authorization from one of the spouses or can prove that you have a personal right to protect in receiving a copy, then it can be granted to you as well.
