Liquor License Violation DefinedLiquor license violation is the illegal act of selling or purchasing alcohol due to failure to obtain a liquor license. Stores, restaurants and other business structures are required by federal and state laws to acquire a liquor license by filing an application indicating the clientele, types of alcohol intended to be sold and area where the selling will be done. On the other hand, clients or customers are also required to have an active legal license in order to purchase alcohol. Those who are not allowed to purchase must not violate laws and sellers must be strict in enforcing this. What The Law SaysIt is illegal for any individual without a valid license to manufacture or sell any liquor unless indicated by legal authorities, provided that the head of any family may produce for family use and not for sale an amount of wine not exceeding two hundred gallons every year, and an amount of beer not exceeding one hundred gallons a year. The maximum gallons may vary depending on the state. It is illegal for any individual without a valid wholesale or manufacturer’s license to import any liquor unless indicated by the state. Any liquor imported into a state should immediately be placed at the warehouse of the manufacturer or wholesaler importing the liquor, shall be unloaded into such warehouse, and will be held in such warehouse for at least forty eight hours before further sale by such manufacturer or wholesaler. It is illegal for any individual to label, designate or sell any liquor using the name of any state unless such liquor is wholly or partially manufactured in the state, and all of the primary ingredients are wholly rectified or combined in the state indicated in compliance with legal departments and authorities. It is illegal for any individual who keeps or maintains any store, restaurant or other business structure where food, beverages or entertainment are sold or provided for compensation, to sell or provide any food or beverages to or for any of the following individuals knowing that such individuals has or is about to obtain liquor for consumption. Minors, individuals under the influence of alcohol at the time, disorderly persons, alcoholic individuals or individuals who intend to consume in any vehicle are not allowed to purchase liquor even with valid licenses. Penalties For ViolatorsAny individual who is guilty of liquor license violation will immediately be sentenced to disciplinary action. Any misconduct in the part of the violator will provide him with an “accusation” document. Administrative hearing in front of a judge will then be required to determine the offense. Further disciplinary actions will also be considered. Liquor license violation can be punishable in fines and imprisonment. Fines can range anywhere from $100 to $10,000. Establishments are bound to pay more for the extra profit made by selling to minors. Imprisonment can last from twenty four hours to one year depending on other incurred misdemeanors or associated felonies while under the influence of alcohol.
