Youth Sex Trade: Penalizing Juvenile Pimping

Juvenile pimping is the act of any individual who receives any money, property, token, object, benefit, article or anything of value from a prostitute under the legal age of consent or from a prostitute who is an institutionalized severely or profoundly mentally retarded person, not for lawful consideration, knowing it was earned in whole or in part from the practice of prostitution.



A juvenile pimp is an individual who buys or sells a child for the purpose of making the child be a party to sexual intercourse or other sexually related activities. The individual may have intentions of producing child pornography or depicting any lascivious poses in illicitly viewed material. The individual may also transport a juvenile who is known to be abducted, kidnapped, sold or bought in a foreign country out of that country for prostitution practices.

Is It A Crime?

Juvenile pimping is a Class 1 felony. Even attempted acts of juvenile pimping are still punishable by law. The following elements are considered when viewing cases of child prostitution.

1. The child. The juvenile is the subject of prostitution practices. He or she is also the victim of the crime who has been engaged or enticed to engage in sexually related activities.

2. The trade. There is intent by the pimp to indulge the child in sexually related activities in exchange for money or any material of value. Other sexual intents are included in the act.

3. The pimp. This is the person who manages or benefits from the practice of prostitution by the juvenile. He or she is also the individual who conducts the trade and willfully engages the child.

What The Law Says

It is strictly prohibited by law to knowingly and willfully cause any juvenile to engage in prostitution, use any juvenile for purposes of prostitution, permit any juvenile under a pimp’s custody or control to engage in prostitution, receive any benefit for or on account of procuring or placing a juvenile in any place or in the charge or custody of any person for the purpose of prostitution, receive any benefit pursuant to an agreement to participate in the proceeds of prostitution of a juvenile, finance, manage, supervise, control or own, either alone or in association with others, prostitution activity involving a juvenile and transport or finance the transportation of any juvenile through or across the state with the intent that such juvenile engage in prostitution.

It is illegal to procure or attempt to procure any juvenile to have unlawful sexual intercourse. Any individual who has unlawful sexual intercourse with a juvenile with or without consent will be guilty of child abuse. Juveniles are not included if they engage in sexual activities with other juveniles. It is illegal for an owner to allow his property to be used for juvenile prostitution practices. Offenders of these will be guilty of child abuse and juvenile prostitution and pimping.

Punishment For Juvenile Pimping

Juvenile pimping can be punishable by fines and imprisonment. Offenders can be fined from $1,000 to $100,000 and imprisoned from thirty days to five years. More serious offenses of child abuse and widespread juvenile pimping will harbor bigger fines and longer jail time.
