Illegal immigration is unlawful entry across international borders, violating the immigration laws set by the countries involved. An illegal immigrant is an alien or person who does not lawfully belong in a certain area due to the coverage limits of his race, documentation or birthright.

National laws strictly prohibit foreign individuals from entering a country without sufficient reason or documentation. Only rightful citizens are allowed to enter the boundaries of their own nation. Citizenship can be acquired by birthright or artificially through proper and legal documents.

A passport and/or visa are required which indicates the place or country where the individual is allowed to enter as well as the length of time the individual is allowed to stay. If the individual does not suffice adequate reason and documentation or if he stays longer than the specified time allowed, he will be charged with illegal immigration.

Sanctions for Illegal Immigrants

Deportment is the most common penalty for illegal immigrants. Violators will be banned temporarily or permanently from the area and transported back to their country after investigation. Fines and imprisonment are also likely. Violators can be charged anywhere from $5,000 to $100,000.

Sentencing and legal proceedings will be done in the violators’ place of origin after deportment. If the illegal immigrant committed felony in a foreign country, sentencing will be done by a foreign court based on the laws of the country. The illegal immigrant will have to pay the penalty abroad or back home depending on national laws for foreigner-committed felonies.
