What Makes Hostage Taking a Crime?

A hostage could be a person, animal, or thing that is held captive. Hostages have two classifications: those seized by force, held captive and treated like a prisoner, and those handed over voluntarily as  proof that one will follow with what was agreed upon. This type of hostage is more like a 'guest'.



Hostages taken by force are meant to give abductors leverage over a certain  situation. They can be used to force another party, e.g., relatives or even the government, to give in to what they want. Hostages can also be used to let the other party stop from acting, like calling the police. Captors usually threaten to physically hurt  hostages after the given ultimatum has expired.

Hostage Taking Is A Criminal Offense

It has been declared by the United Nations that hostage taking is a crime and an act of terrorism. It is a violation of human rights and violation of a person’s liberty.

Seizing a person and using them as leverage to gain something is a criminal offense. It is a grave criminal offense not just by the laws of the United States but also of International Laws.

A situation is in the jurisdiction of the United States law if it is happening within the United States territory. If the situation is outside of United States territory it will still be under the law of United States if the persons involved, be they the offenders or the seized, are nationals of the United States.

ne very popular use of hostage taking is kidnapping. Kidnappers abduct a certain individual and contact the relatives. They will then ask something in exchange for the release of their abductee. Most often than not the kidnappers would ask for money but there are some instances that they ask for something else. For example rebels would capture a head officer of a military camp. They then send out a ransom but not for money. In exchange for the release of the head officer, they ask for the release of their imprisoned comrades.

Punishment for Hostage Taking

Hostage taking is a grave criminal offense. It has been condemned even by the United Nations. In the United States, punishment for hostage taking is imprisonment for any number of years up to life imprisonment. If during the hostage taking a death of a person involved in the situation occurs then the punishment would be life imprisonment to death penalty.
