Copyright Infringement = Stealing!

What is copyright infringement? If someone else thinks of it, can't I think of it as well? What copyright means and how it is intended to protect the intellectual ideas of someone.


Copyright infringement is the illegal use of copyrighted material. It is also known as copyright violation, wherein the user breaches one or more exclusive rights of the original copyright owner. Since only the original copyright owner can recreate, replicate, execute and add to the copyrighted product or service, any other person who does this will be charged with copyright infringement under law.

Where Copyright Infringement Commonly Occurs

Bootlegging is a colloquial term, which is synonymously used in conjunction with illegally copied products or services. There are several forms of bootlegging for audio-visual materials and electronic devices. In the music industry, there are bootleg recordings, wherein copies of songs, demos and live performances are sold or traded to the public without the artists’ or production companies’ consent. These products are widely termed as “bootleg” by buyers and traders in the music industry. They may now be known under the term “piracy,” but the manner by which they are reproduced and released is still illegal and covered by copyright law.

Piracy and theft are the more common terms associated with audio-visual and electronic media. The two generally are identical, in the sense these are unauthorized reproductions and releases of media sans the artists’ or production companies’ permission. Piracy is very rampant, especially in the movie and music industry, where unauthorized copies of DVDs and VCDs are distributed and sold to the public, even before the actual date of release is due.

The Different Levels of Infringement

Internet sites are also responsible for the illegal downloading of audio-visual media, where viewers can acquire MP3s and audio and media files. Sharing copied audio-visual material, provided that they were not illicitly obtained, is allowed in some countries, as long as they are not sold or advertised.

Illicitly copied text or documents are also covered by copyright law. A person may not copy text or specific statements written by the original author without consent. This type of copyright offense is more common among writers and in the internet. Oftentimes, the writings of the original author is blatantly used, or worse, misused. This duplication of written material also removes recognition where it is due.

Original copyright owners pay huge sums of money in order to have exclusive rights over their product or service. When the appropriate dues are paid, the copyright owner will have sole rights to perform or build on the product or service over a given period of time. Any other person who wishes to perform or build on the same product or service will have to acquire the consent of the owner, as well as pay for certain rights to access it.

Reverse piracy is the term used to describe the misuse of authorized text, documents and performances by the legal holder. If the legal holder exploits or willfully confines use or improvement of material, it is an informal form of copyright abuse.

Penalizing Copyright Pirates

Penalties for copyright infringement depend on gravity and extent. Fines can range from $10,000 to unlimited. The offender may also be imprisoned from six months to ten years. Some offenses may cause a lot of damage in the artists’ or production companies’ reputation, thereby requiring more monetary compensation.
