Are You Guilty of Consensual Crime?

What is consensual crime? Can anything  be a crime if you agree? How should we define crimes that someone, at the time, might actually agree to? Are we always aware? Some examples of real situations.


A consensual crime is a general term, which encompasses those crimes wherein more than one person is involved and everyone gives their tacit or spoken agreement to be part of it. The exceptions to consensual crimes are those wherein one or more of the parties are children, animals, those who are mentally or physically disabled, under the influence of drugs or alcohol or unconscious. If there has been a lack or omission of information or one of the individuals is acting under duress, these cannot be considered as consensual crimes as well.

Types of Consensual Crimes

A common consensual crime would be statutory rape, wherein the underaged individual may have agreed to sexual intercourse but the law has determined that they cannot be regarded as capable of giving informed consent. Oftentimes, the punishment for statutory rape is several years of imprisonment.

The morality governing euthanasia on the other hand, is not as clearly defined. One point of view holds that the individual who is solely dependent on a life support system and may be experiencing chronic pain and suffering should be allowed to die. On the other hand, the opposing point of view states that individuals should follow the natural course of life and death and no other individual should play a part in determining whether one should live or die. Physicians who are found guilty of assisting patients in suicide could be charged for homicide or murder, depending on the circumstances and could receive punishment in the form of the death penalty or life imprisonment.

Polygamy is another consensual crime wherein an individual has more than one spouse at the same time. While polygamy is accepted in some cultures, it is considered illegal in most Western countries. Multiple marriages and divorces can actually be done to prevent being accused of polygamy. If you intend to immigrate to another country, polygamists generally have a difficult time at being given approval of a new citizenship. The transmission of a sexual disease can also be considered as a consensual crime, since this could result in serious injury or hazards to one’s health.

Another consensual crime that has risen in numbers as of late is suicide terrorism. Often affiliated with fundamentalist religious groups, one or more individuals will commit suicide in the name of a cause or belief. The suicide often involves the death of more individuals within a specific area or context such as the recent bombings of government landmarks and more infamously, the 9/11 incident, which changed the landscape of world history forever. While harsh and exacting punishment is doled out to suicide terrorists, they are often difficult to catch if the crime is unsuccessful or cannot be persecuted if they have managed to kill themselves in the process of committing suicide
