Bail is a form of security that comes in the form of money, which has to be given in exchange for the temporary freedom of a person who has been arrested. Returning the bail is not dependent on whether the accused person was found guilty or not as this is customary procedure that is followed each time.

Types of Bail Offenses

There are several types of bail that may be available depending on the legislation in the state. First, recognizance is just a promise to be present in court hearings and being crime-free in the duration of the legislative process. There is often no need to pay any monetary amount, although there will be a fine set on the occasion that the stipulations mentioned are not followed.

Another kind of bail is orders of protection, which puts limitations on the release of the defendant. There is of course, a requirement that the defendant will not engage in any criminal activity but more importantly, there will be an automatic restraining order placed on the defendant to stay away from the victim. Violation of these stipulations could lead to a return to imprisonment alongside the forfeit of the bail and additional fines and punishments.

Bail could be a release on conditions. This means that the defendant has to comply with certain requirements while being free on bail, which includes reporting to a police officer on a daily basis during an appointed time so that they can keep track of your whereabouts and actions. Aside from this, you may also be asked to surrender your passport so that you will not be able to travel out of the country. You may also be detained at home and cannot leave the premises of a given vicinity without informing your bail officer first. This ensures that actions are closely monitored and there will be very little likelihood that the accused will commit the same crime again.

Bail offenses are grave and serious because you are losing the trust the court has placed on you by trying to escape when you have upcoming trial dates or returning to crime before you are even prosecuted. Bail offenses could actually destroy your chances of receiving a lighter sentence or being let off the hook for your crime since this demonstrates your lack of responsibility and accountability over your actions and that there is a very high likelihood that you will return to a life of crime.
