Abortion As A Criminal Act: Guide To Premises, Procedures, And Legalities

Abortion is the expulsion of an embryo or fetus that is incapable of independent survival through induced termination of pregnancy.

Abortion can be performed in a number of ways, depending on the different circumstances that are present, and also depending on the development of the embryo or fetus. There are three trimesters wherein the process of abortion may be performed, each with a particular method conducive for the circumstance.


How Is Abortion Done?

In the first trimester, one method used is the injection of Methotrexate in the womb. The chemical attacks the cells surrounding the embryo, depriving if of food and oxygen, which ultimately causes its death. A more popular method for a first trimester abortion would be the vacuum curettage, wherein a vacuum tube with sharp cutting edge is inserted in the cervix, sucking out the baby’s body parts, blood and tissue. Dilatation and curettage method, which is also used in the early second trimester abortions, places a loop shaped steel knife inside the cervix, cutting up the fetus.

Second trimester methods, on the other hand, includes Dilation and Evacuation, which uses forceps instead of a loop shaped steel knife to rip away pieces of the fetus. Prostaglandis injection is also used to prematurely induce labor. Salt poisoning is also used to abort fetuses by replacing the amniotic liquid that surrounds the fetus with concentrated salt that burns the fetus. This method is also used in the early trimester of the pregnancy.

In the third trimester, Urea injection is performed, which is similar to salt poisoning but is not as strong. Hysterotomy, which is the act of removing the baby, placenta and amniotic sac from the abdomen through an incision, is also performed in this trimester, usually when after all forms of abortion have been unsuccessful. The last type of abortion method is the partial birth abortion wherein the baby is partially delivered, leaving the head inside the womb, and using scissors, the doctor makes an opening into the back of the baby’s skull where a vacuum sucks the baby’s brain out.

Abortion Laws In the U.S.

Although some forms of abortion are considered illegal in some states in the U.S., partial birth abortion still remains to be legal in almost the entire United States, which is partly due to the misconceptions surrounding the subject. Although there are several recommendations to endorse the partial birth abortion ban, the senate is still unable to make it completely illegal because of issues surrounding the health-based reasons of women who may need the abortion in order to save their lives.

According to certain laws of some states, partial abortion is allowed only if such procedure is necessary to save the life of the mother especially in situations wherein the mother’s life is in jeopardy due to some physical disorder, physical illness or injury, including those which are caused by the pregnancy itself. This clause allows those people who carry them out to have a legal defense against the law that prohibits it, just as long as it was done under the specified conditions.
