What is the US Bankruptcy Court?

The US Bankruptcy Court performs an important and ‘heavy’ task. If you are researching about bankruptcy or contemplating on filing for one, read this article first.

The US bankruptcy court is the governing body in the United States for bankruptcy cases. It is the court that specializes in bankruptcy cases, which cannot be filed in state courts like other legal proceedings. All ninety-four of the federal judicial courts located in different states are considered as part of the United States bankruptcy court. It is the bankruptcy judge, who presides for fourteen years upon appointment, who has the final decision over all matters in this court.

What Does the US Bankruptcy Court Do?

The US bankruptcy court handles incidents of bankruptcy wherein a company or an individual is financially incapable of paying off all their creditors. Each of the bankruptcy courts maintains a website where the local bankruptcy rules can be downloaded for free. Part of their responsibility is fielding inquiries regarding bankruptcy to local citizens, ensuring that citizens comply with the procedure for filing bankruptcy and providing them with the adequate forms needed for this.

All bankruptcy courts also hold relevant bankruptcy records which can be obtained either through their electronic records database, voice case information system or in person. They also respond to requests for certified copies, which are usually done through a written statement sent through postal mail.

If you are listed as a creditor in a bankruptcy case, the bankruptcy court should send you a proof of claim form. You can also download this form from the website of the bankruptcy court or request for this in person at the clerk's office. Just make sure that you file this claim at the bankruptcy court within ninety days so that it can be formalized.

Other Information You Can Obtain…

The bankruptcy court in your state should also provide adequate information regarding the background of all the judges. They also assist with court sponsored programs such as the debtor assistance project or mediation program, which is directed towards individuals or companies who may need further guidance and support regarding their bankruptcy.

Aside from these, the US bankruptcy court is also tasked with providing citizens regarding local statistics on bankruptcy whether as point of reference or a source of research. The bankruptcy proceedings filed in the local court serves as the basis for the data mining and analysis for each state.
