Parties should be vigilant with checking the status of their pending court cases. Although it is generally the duty of counsels to inform their clients of the status of the proceedings, the latter should still exercise due diligence in making sure that their suit is being acted upon by the court. Take note that clients are generally bound by the negligence of their counsel.
Pending court cases are proceedings which have not yet been terminated by a
dismissal, withdrawal, or a decision on the merits. The suit is still alive, so
to speak, and the parties are still allowed to present evidence until such time
as the court declares that case is already submitted for resolution. The rationale behind this proscription is to prevent the court from being influenced by the publicity that each party might create when they drum up for public opinion or support. Any party who violates this rule can be cited for contempt.Although the parties are still allowed to be heard while the case is still pending in court, there’s a limitation as to the number of pleadings or evidence that they may file or proffer. For example, a complaint or an answer thereto cannot just be withdrawn or modified without the permission of the court. If parties are allowed to change their pleadings or position for an unlimited number of times, then there would be no end to the controversy. Many of the courts in the United States have their own Web site which hosts both pending and decided cases. Access to pending court cases are generally limited compared to suits that have already been decided upon.The Public Access to Court Electronic Records or PACER, contains lists of both pending and decided cases. You may also call the court clerk for the status of a case.
