Conducting a Legal Records Search
A legal records search has for its object any document which may have a
bearing in a particular suit. The search can sometimes be a tiresome task,
especially if one opts to personally look for it in the court where it has been
filed. However, online databases have made it more easy and convenient to search
for legal records.
Conducting a legal records search can be time consuming if you want to do it
by yourself. The undertaking can be easy though, if you hire experts for the
purpose. But just what are legal records anyway? These are records that are used
or intended to be used within the legal system. These come in various forms like
court records and transcripts, wills, notarized statements, or any other
documents submitted as legal evidence in court cases. If used in a case, these
documents essentially form a substantial portion of the entire court record.
Copies of legal records are not that easy to come by if you are not directly
involved in the case. A subpoena can be issued for their production if they are
essential to your own case. They can also be requested through the court clerk,
being the designated custodian of judicial records.
Normally, one would hire a lawyer (especially if he or she is involved in a
case) to retrieve these legal records. Otherwise, a request form must be filled
out and submitted to the court clerk. After payment of the appropriate fee, the
applicant would then be handed a copy of the record.
Online Legal Records Search
To avoid the difficulties of doing a legal records search “manually”, one can
always look for it on the Internet.
The first way is to make a request through PACER, or Public Access to Court
Electronic Records. This is the U.S. Federal Court’s online system that provides
basic information about court cases. It also processes online requests for
copies of these records. This is available in most courts.
Each court (that is part of the PACER service) maintains an online database of
court records. However, it only stores a limited amount of information. And
because each court maintains its own database, they also have their own
respective URLs, not to mention that they may also have different formats. As
such, one needs to know the particular URL of the court where he wishes to
retrieve the legal records from. Fortunately, the
PACER Service Center
maintains a list of links to all of the courts within the system. To avail of
the PACER service, one needs to first register through the PACER Service Center.
Further, PACER provides a phone service that gives out case information for
free. The only limitation here is that this information is confined only to the
basics like case names, case numbers, parties involved, verdicts, etc.
The least obtrusive means of getting legal records online is to resort to other
Web-based service providers. Online detectives can get you the information that
you need for a fee.
